TERMS AND CONDITIONS – SMT-RC Struik Model Technology

Article 1 – Definitions

  • Withdrawal period: the period during which the consumer may exercise the right of withdrawal;

  • Consumer: a natural person acting outside their trade or profession;

  • Day: calendar day;

  • Durable medium: any tool enabling storage of information;

  • Right of withdrawal: the consumer’s right to cancel within 14 days;

  • Trader: SMT-RC Struik Model Technology;

  • Distance contract: a contract concluded via remote communication.

Article 3 – Applicability

These terms apply to all offers and contracts between trader and consumer.

Article 4 – Offer

All offers are non-binding. Obvious errors are not binding.

Article 5 – Agreement

The agreement is concluded when the consumer accepts the offer.

Article 6 – Right of withdrawal

  1. The consumer has the right to withdraw from the contract within 14 days without giving any reason.

  2. The withdrawal period starts the day after receipt of the goods.

  3. The consumer must handle the goods with care during this period.

  4. Goods should be returned in original condition where possible.

Article 7 – Costs in case of withdrawal

  1. The consumer bears the direct cost of returning the goods, unless the item is defective or incorrectly delivered.

  2. The trader will reimburse all payments, including standard delivery costs, within 14 days of withdrawal.

  3. The trader may withhold reimbursement until the goods are received or proof of return is provided.

  4. Any diminished value due to excessive handling may be charged.

Article 8 – Exclusion of withdrawal

The right of withdrawal may be excluded for:

  • custom-made products;

  • sealed goods unsuitable for return for hygiene reasons once unsealed.

Article 9 – Prices

All prices include VAT.

Article 10 – Conformity and warranty

Products must conform to the contract.
Defective or incorrect items are returned at the trader’s expense.

Article 11 – Delivery

Delivery is made to the address provided by the consumer.
Risk transfers upon delivery.

Article 12 – Payment

Payment must be made according to the terms stated in the webshop.

Article 13 – Complaints

Complaints will be handled within 14 days.

Article 14 – Applicable law

Dutch law applies.

Article 15 – Final provisions

Any deviations must be agreed in writing.

Additional provision – International returns

For international returns, the consumer bears the return shipping costs.
These costs may vary depending on the country and carrier.
